A. No Purchases by Minors

By ordering a product or service from Kohburg, you represent that you are 18 years of age or older. If a child under the age of 18 orders a product or service from Kohburg without parental or guardian permission, then the parent or guardian may return the product or service for a refund according to the posted returns and exchanges policy that relate to that order.

B. Shipping, Handling and Insurance

You are responsible for paying all postage and handling charges relating to your purchases (including any product offered with a service), and for insuring your purchases. All merchandise delivered to customers will be insured upon request. Please make sure to review your confirmation e-mail (receipt) after you place your order, and contact us within 24 hours if any information on the confirmation e-mail is incorrect. You are responsible for delayed shipping time or extra shipping fees as a result if you enter incorrect or insufficient shipping information when placing orders. Please review our shipping information page available at our online store regarding our shipping policies. (FedEx will charge $10 per package for each address modification after we ship out your order. We will apply such additional surcharges to your account upon receiving FedEx's notification and/or invoice.)

C. Prices and Payments

All prices are in effect on the date of purchase. All orders must be accompanied with payment in full by credit card, check, or money order, unless otherwise approved by Kohburg in written. Credit card payment must be authorized, signed, or executed by the cardholder. Your order will not be shipped until payment is received and cleared. We only accept purchase orders with payment terms from public schools and charter schools. Private schools may be qualified to enroll our Flex Finance program. We will charge $35 per bounced check to cover our bank's service fee. In the event your credit card is declined, we will keep the order on "hold" for up to, but no longer than 30 days. We kindly ask that you contact us with a valid form of payment or verify the credit card information given. Any unpaid sales orders will be cancelled if payment has not been received within 30 days from the date the order was placed.

D. Purchase Orders

We accept Purchase Orders from Public Schools, Charter Schools and other customers with approved credit terms. Purchase Orders can be submitted via fax, email or mail. Be sure to include the following information on all Purchase Orders. Any Purchase Orders with missing information will not be processed and will delay the receipt of your order.

• Contact Name(s) & Phone Number(s)
• Director or buyer signature

You will receive an order confirmation from your Account Manager acknowledging we have received and are processing your order. If you do not receive this confirmation within 3 business days, please contact your Account Manager immediately to address any possible processing issues. Invoice terms for credit accounts are Net 30 days. Orders are invoiced on the date of shipment. All shipping fees will be at the customer's cost and payment must be submitted within 30 days from the invoice date. Kohburg reserves the right to modify or decline any credit application or payment terms based on customers' payment histories and credit rating. Kohburg reserves the right to demand full payment if a scheduled installment is past due or payment is in default.

E. Designs, Materials, Pricing Changes

Our Research & Development and Design Teams continuously work together to improve both the quality and design of our products. We reserve the right to modify designs, dimensions, and/or improve materials without prior notice. Listed product dimensions are approximate and intended for product description information. We make every effort to display accurate product information on our website, catalogs, and marketing materials but cannot be held responsible for any inadvertent typographical or design errors. We reserve the right to update website, catalog, and price list(s) price changes that may arise from un-foreseen circumstances such as material and labor cost increases. The items posted on the website and in the catalog do not constitute an offer or solicitation for sale. F. Order Inspection

Upon receiving your order, please thoroughly inspect each and every package of the shipment. Please keep precise notes of any damaged or missing boxes on your delivery receipt, and request the carrier to sign. If any packages or products are damaged during shipping, please keep the ORIGINAL packaging and take photos of the damaged carton for claims processing. Please contact your Account Manager immediately so we can assist you in addressing all problems and issues.

H. Product Care

Kohburg furniture is built with longevity in mind but a little extra care goes a long way. Maintaining a regular cleaning schedule keeps your furniture beautiful and assures prolonged strength and dependability. Please refer to our "Product Care" webpage for complete details. Kohburg reserves the right to update the Product Care page at any time without prior notice.

I. Returns & Exchanges

At Kohburg, we stand behind our quality. To ensure our customers' satisfaction, we inspect each and every product before it's shipped. J. Limited Warranties

The limited warranty covers defects in material and workmanship on most Kohburg Furniture from the date of purchase from Kohburg. Please refer to the "Warranty" webpage for complete details.

K. Refunds and Credits

Refunds will be issued in the form of either credit to the original cardholder or check mailed to the customer's billing address. Credits will be applied to customer's account at Kohburg.

L. Taxes and Duties

You are responsible for paying all sales, use, and other similar taxes relating to any of your online purchases of products or services from Kohburg. If you are international customers, you are in addition responsible for paying any custom duties, broker fees, custom exam fees relating to any of your imported orders from Kohburg.

M. Limitation of Liability

You agree that Kohburg shall not be liable for any damages including damages for direct, indirect, special, punitive, incidental, exemplary, or consequential damages even if such damages were reasonably foreseeable or even if we had received actual notice of the possibility of such damages, whether the action arose from contract, negligence or any other theory arising out of or in connection with the use of the information, services, products and material. By placing the order with Kohburg, you acknowlege that you are an English speaker who reads and understands all terms & conditions published at Kohburg website. You completely release Kohburg from any and all claims arose from the use of Kohburg furniture.

N. Laws and Regulations

By placing the order, customer hereby agrees all terms and conditions specified above. Your sales order will become a legal contract effective the date of your purchase. The terms and conditions, as well as the sales order contract is subject to the laws of the State of California. Kohburg reserves the rights to revise, amend, or interpret this Terms and Conditions at anytime without prior notice.
